Version: 2.0Last Updated: 13 April 2026Welcome to JCKFRUT (Pty) Ltd (“JCKFRUT,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website at https://wedding.jckfrut.co, the wedding management platform, all planning tools, communication systems, guest management features, vendor collaboration tools, and any related services (collectively, the “Platform” or “Services”).
These Terms form a legally binding agreement between:
• JCKFRUT (Pty) Ltd, a company incorporated in South Africa (Company Registration No.: K202006630707), with its principal place of business at 11th–14th Floor, Touchstone House, 7 Bree St, Cape Town City Centre, Cape Town, 8001; and
• You, the individual or entity who visits, registers for, or uses the Platform in any capacity (“User”).
By creating an account, accessing any part of the Platform, accepting a collaborator invitation, or submitting an RSVP, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
These Terms must be read together with our Privacy Policy, Cookie Policy, and where applicable our Refund Policy, all of which are incorporated by reference. Where you are located in the European Economic Area (EEA), the United Kingdom, or another jurisdiction with equivalent data protection laws, additional provisions in Section 13 apply to you.
The following definitions apply throughout these Terms. Words in the singular include the plural and vice versa. "Platform" or "Services" — the full suite of features and tools available at https://wedding.jckfrut.co, including invitation creation, save-the-date tools, RSVP management, guest list management, seating planner, vendor planning, logistics, itinerary builder, finance and budget tools, transport and accommodation planning, in-platform chat and communications, collaborator access controls, broadcast email tools, and all AI-assisted features. "Couple" — a User (or pair of Users) who creates an invitation, event, or wedding project on the Platform. Couples are the primary account holders and administrators of their wedding dashboard. "Guest" — an individual whose details are added to the Platform by a Couple, or who submits an RSVP through the Platform. Guests are not required to create a full account. "Vendor" — any wedding industry professional (including photographers, florists, caterers, entertainers, decorators, and wedding planners) who is invited by a Couple to access a specific dashboard as a Collaborator. "Collaborator" — any Vendor or individual who has been granted scoped access to a Couple's dashboard through the Vendor / Access Controls invitation system. "Chat" or "In-Platform Communication" — the messaging feature that allows Couples and Collaborators to communicate within the Platform, with each message generating an email notification to all parties in the conversation. "Chat Record" — the stored log of all in-platform communications between a Couple and their Collaborators, retained by JCKFRUT for the period described in Section 14. "Event" — any wedding, reception, pre-wedding function, or related celebration for which an invitation or RSVP is created on the Platform. "User Content" — any content that a User (including Guests or Collaborators) uploads, posts, submits, or transmits through the Platform, including text, images, RSVP responses, chat messages, and planning notes. "Tier" — the pricing plan selected by a Couple (Basic, Boutique, or Grand), each of which unlocks different features as described in Section 7."Save the Date" — the free digital save-the-date feature available to all registered Users regardless of Tier. "RSVP Dashboard" — the RSVP management and guest tracking tools, the free access to which is limited to the first 50 guest records on the Basic Tier. "Seating Planner" — the drag-and-drop table and seat assignment tool, including the AI Seating Suggestions feature. "AI Feature" — any functionality on the Platform that uses artificial intelligence or automated algorithms to generate suggestions or output, including AI Seating Suggestions and Auto-build Itinerary. "Broadcast" — a bulk email communication sent by a Couple to their guest list or a subset thereof via the Platform's Communications module. "Itinerary" — the wedding-day run-of-show document that can be created on the Platform and shared with guests and Collaborators via email and PDF export. "POPIA" — the Protection of Personal Information Act 4 of 2013 (South Africa). "GDPR" — Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation), and where applicable, the UK GDPR as retained in UK domestic law. "ECT Act" — the Electronic Communications and Transactions Act 25 of 2002 (South Africa). "CPA" — the Consumer Protection Act 68 of 2008 (South Africa). "EEA" — the European Economic Area, comprising EU member states, Iceland, Liechtenstein, and Norway. "Sub-Processor" — any third-party service provider engaged by JCKFRUT to process personal data on its behalf. Age and Legal Capacity: You must be 18 years or older and legally capable of entering a binding contract. If you are under 18, a parent or legal guardian must create the account, agree to these Terms, and actively supervise your use of the Platform. Accurate Information: You agree to provide true, current, and complete information when registering or submitting data through the Platform and to update it promptly if it changes. Authority: If you access the Platform on behalf of another person or a business entity, you represent and warrant that you have full authority to bind that person or entity to these Terms. Legal Compliance: You may use the Platform only for lawful purposes and in compliance with all applicable laws in your jurisdiction, including data protection and consumer protection laws. Prohibited Users: You may not use the Platform if you have previously been suspended or removed by JCKFRUT, or if doing so would violate any applicable law.Account Types Couple / Individual Account: Used by one or two people to create and manage a wedding project, including invitations, guest lists, events, and all planning tools available under their selected Tier. Business / Agency Account: Used by wedding planners or other professionals to manage multiple client accounts. You must hold written authorisation from each client before adding their data to the Platform. Collaborator / Vendor Account: Created when a Couple sends a Collaborator invitation. These accounts are scoped and may only access the sections of the Couple's dashboard that the Couple has explicitly enabled. Guest Profile: Not a full account. Guests are added by Couples and interact with the Platform only through RSVP forms and, where applicable, itinerary emails. Guests do not log in. Registration Obligations • Provide accurate, current, and complete information during registration, including a valid email address.• Choose a secure, confidential password. If you register using a third-party login (e.g. Google), you remain responsible for the security of that login.• You are solely responsible for all activity under your account and must not share your login credentials with any third party outside of the Collaborator invitation process.• Notify us immediately at info@jckfrut.co if you suspect unauthorised access or a security breach.• JCKFRUT is not liable for losses caused by unauthorised access resulting from your failure to safeguard your credentials. One Account per Wedding EventUnless you are a Business / Agency managing multiple clients, you may not create multiple accounts for the same wedding event to circumvent plan limits or fees. Cancelled WeddingsIf your wedding is cancelled, you may request account closure by emailing wedding.support@jckfrut.co. Closure does not entitle you to a refund of amounts already paid. JCKFRUT will retain data for the minimum period required by applicable law and these Terms, after which it will be deleted. If you have active Collaborators, JCKFRUT will revoke their access upon account closure.Inviting Collaborators • Couples may invite Vendors and other individuals as Collaborators by sending a platform invitation via the Vendors / Access Controls section of their dashboard.• Each Collaborator receives login credentials and access only to the sections the Couple has selected. Couples may grant or revoke access at any time.• JCKFRUT provides the technical mechanism for Collaborator access but is not a party to any agreement between a Couple and a Vendor. JCKFRUT has no responsibility for the quality, conduct, or performance of any Vendor. Collaborator Obligations • By accepting a Collaborator invitation, the Vendor or Collaborator agrees to these Terms in full and to the Acceptable Use Policy in Section 9.• Collaborators may only use the access granted to them for the legitimate purpose of assisting with the relevant wedding. Using that access for any other purpose is a material breach of these Terms.• Collaborators must treat all information accessed, including guest data, financial data, and Chat Records, as strictly confidential and may not disclose it to third parties without the Couple's written consent.• Collaborator access automatically terminates when the Couple revokes it, closes their account, or when the relevant Event date passes. Couple Responsibility for Collaborators Couples are the "responsible party" (as defined in POPIA) and the "controller" (as defined in the GDPR) for all Guest data they share with Collaborators via the Platform. By granting a Collaborator access to sections containing personal data, a Couple confirms they have a lawful basis to share that data with that individual and that doing so is necessary for the planning of the Event. Data Processing Agreement for Business / Agency Users Where a Business / Agency User processes personal data belonging to their clients on the Platform, that User acts as a data processor on behalf of their client (the controller). Such Users must ensure that a lawful data processing agreement is in place with each client before adding that client's data to the Platform. JCKFRUT provides a standard Data Processing Addendum (DPA) on request for business users who require one for GDPR or POPIA compliance purposes. Purpose and Function The in-platform chat feature allows Couples and their Collaborators to communicate about wedding planning within the Platform. Every message generates an email notification to all parties in that conversation thread. The feature was designed specifically to create a verifiable, time-stamped record of communications between Couples and their Vendors. Storage of Chat Records • All chat messages sent via the Platform are stored as Chat Records.• Chat Records are retained for 24 months after the Event date, after which they are permanently deleted, unless JCKFRUT is required to retain them longer to comply with applicable law or to resolve a dispute.• Couples and Collaborators may access their Chat Records at any time by logging into the Platform for as long as the data retention period applies.• Deleting a wedding project or closing an account does not immediately delete Chat Records where a dispute is pending or a legal obligation applies. Admissibility and Legal Use of Chat Records • Chat Records are stored to provide a verifiable, time-stamped record of all communications. Either party may refer to their Chat Records in the event of a dispute.• JCKFRUT may be required to disclose Chat Records in response to a valid court order, subpoena, or other lawful legal process, and will notify the affected User where legally permitted to do so.• By using the chat feature, you acknowledge that your messages are being stored and may be accessed for the purposes described in these Terms. Content of Chat Messages • Chat messages must comply with the Acceptable Use Policy in Section 9.• Do not send sensitive personal information (e.g. payment card numbers, ID numbers, or medical details) via the chat feature.• JCKFRUT does not actively monitor chat content in real time but reserves the right to review Chat Records where there is a report of a violation, a legal obligation, or a dispute resolution request. Email Notifications By using the chat feature, all participants consent to receiving email notifications for each new chat message. These are service-related communications and cannot be disabled while you remain an active Collaborator on a project. Overview of Tiers • Basic (Free): Includes save-the-date tools, RSVP tracking for up to 50 guests, dashboard overview, events module, and selected base features.• Boutique (Mid-tier paid): Includes one invitation template, advanced RSVP features, guest invitation email, seating planner, AI seating suggestions, vendor planning, logistics, finance, and communications.• Grand (Premium paid): All features unlocked, including all invitation templates, full collaborator access, transport and accommodation planning, full communications suite, and all current add-ons. Pricing & Currency Prices are geo-determined and presented in the currency most relevant to your detected location (ZAR, USD, EUR, or GBP). The applicable price is the one displayed to you at checkout at the time of purchase. Once-off payments are non-refundable after the applicable refund window except as stated in the Refund Policy. Save the Date Save-the-date functionality is free for all registered users. Communications sent via this feature carry JCKFRUT branding. Free RSVP Dashboard (Basic Tier) Basic Tier users may manage RSVPs for up to 50 individual guest records at no charge. Once the 50-guest threshold is reached, an upgrade to Boutique or Grand is required. Guest List Builder Couples may create and manage their guest list directly within the Platform, organised by household, with fields for RSVP status, dietary requirements, event invitations, and transport needs. Seating Planner & AI Seating Suggestions The Seating Planner allows Couples to create table layouts and assign guests to seats. AI Seating Suggestions are illustrative only. JCKFRUT makes no warranty as to their suitability, and the Couple is solely responsible for all final seating decisions. Invitation Metrics / Invited Events The Invited Events feature allows Couples to control which guests are invited to each individual Event. Access controls are the Couple's responsibility. Itinerary Couples may create a wedding-day itinerary and share it with guests and Collaborators via email and PDF export. The Couple is responsible for its accuracy. Logistics, Finance, Transport & Accommodation These are planning tools only and do not constitute professional logistical, financial, or travel advice. JCKFRUT is not a party to any financial arrangement, transport contract, or accommodation booking arising from use of these tools. Communications Module Couples may customise email templates, send Broadcasts to their guest list, and manage automated RSVP reminder settings. Couples may only send emails to guests who have been legitimately invited to their Event. Vendor Planning The Vendor Planning section allows Couples to plan and share details with their Collaborators across categories including florals, menu, decor, entertainment, photography, ceremony, and reception. Multiple Events Couples may create multiple Events within their wedding project. The number of Events may be subject to Tier limits as displayed on the Platform. Custom Invitations Bespoke custom invitation designs are available on request under a separate written agreement. Custom work begins only after full payment and a signed project agreement. Photo & Image Rights By uploading photographs or images to the Platform, you represent and warrant that you own or hold the necessary rights to use and share those images, and that any identifiable individuals depicted have given their consent. JCKFRUT will not use uploaded images for any purpose other than displaying them within your wedding project. Invitation Link Sharing Each invitation is hosted at a unique URL. JCKFRUT is not responsible for any unintended access resulting from a Couple or Guest sharing a link beyond the intended audience. JCKFRUT recommends Couples use Private mode for all invitations. Service Changes JCKFRUT may add, modify, or discontinue features at any time. Where changes materially affect active wedding projects, JCKFRUT will provide advance notice by email and on the Platform.Pricing & Currency Prices are geo-determined and displayed at checkout in ZAR, USD, EUR, or GBP. Any currency conversion fees charged by your bank or card issuer are your responsibility. Payment Processing All payments are processed by Paystack. JCKFRUT does not collect, store, or have access to your payment card details. By completing a purchase, you also agree to Paystack's terms of service (paystack.com). JCKFRUT is not responsible for any errors or failures arising from Paystack's payment processing services. Activation Paid Tier features become active once full payment is confirmed by Paystack. Upgrades You may upgrade your Tier at any time. Once-off payments are non-transferable between separate wedding projects. Cancellations & Deletions To remove a paid wedding project, email wedding.support@jckfrut.co with a deletion request. JCKFRUT will action the deletion within five (5) business days. Deletion does not entitle you to a refund. Refund Policy Refund terms are governed by JCKFRUT's Refund Policy, available on the Platform. Unless that policy expressly states otherwise, once-off purchases are final after the applicable refund window has passed. Chargebacks If you initiate a chargeback that is subsequently resolved in JCKFRUT's favour, you agree to reimburse JCKFRUT for all reasonable costs incurred, including payment processor penalties. Non-Payment Where a payment is not received or is reversed, JCKFRUT reserves the right to immediately revert your account to the Basic Tier and restrict access to paid features without prior notice. Prohibited Content You must not:• Upload, share, or transmit any material that is unlawful, defamatory, obscene, hateful, discriminatory, or otherwise objectionable.• Infringe any person's intellectual property, privacy, or publicity rights.• Use the chat or communications features to harass, threaten, or intimidate any person. Prohibited Conduct You must not:• Attempt to reverse-engineer, decompile, or gain unauthorised access to any part of the Platform.• Distribute malware, spam, or any harmful code through the Platform.• Interfere with or disrupt Platform operations or the experience of other Users.• Use automated scripts, bots, or scrapers to interact with the Platform.• Circumvent file-size, storage, guest count, or feature restriction limits.• Create fraudulent, misleading, or fictitious invitations or events.• Impersonate any person or organisation.• Share your account credentials with any person not invited through the official Collaborator process. Data Obligations • Do not add a guest's personal information to the Platform without a lawful basis to do so under POPIA and, where applicable, the GDPR.• Do not request or store guests' sensitive personal information unless strictly necessary and lawful under applicable law.• Collaborators must not use guest data for any purpose other than the specific wedding project for which access was granted. Branding You may not alter, conceal, or remove JCKFRUT branding, watermarks, or footer credits unless explicitly authorised in writing by JCKFRUT. Enforcement JCKFRUT may suspend or terminate accounts, remove offending content, and take any other appropriate action, including referring matters to law enforcement, for violations of this Policy. • You may send emails to your guests via the Platform's Communications module, including wedding invitations, save-the-dates, RSVP confirmations, RSVP reminders, itinerary emails, and thank-you emails.• You may only send emails to individuals who have been legitimately added to your guest list. Using the Broadcast feature to send unsolicited commercial communications or spam is prohibited.• You are responsible for ensuring that all emails comply with applicable anti-spam laws, including POPIA, GDPR (where applicable), the ECT Act, and the CAN-SPAM Act (where applicable).• JCKFRUT sends emails on your behalf but does not review email content before sending. You are solely responsible for the content of all emails sent through your account.• JCKFRUT includes its branding in emails sent via the Platform. This cannot be removed.• If a guest requests to stop receiving emails from your account, you must action that request promptly. JCKFRUT includes an unsubscribe mechanism in all guest-facing emails as required by applicable law.• Automated RSVP Reminder frequency and stop dates are configured by you. You are responsible for ensuring reminders are sent only to guests who have not yet responded and who have not opted out. Your Ownership You retain all intellectual property rights in User Content you submit. JCKFRUT does not claim ownership of User Content. Licence to JCKFRUT By submitting User Content, you grant JCKFRUT a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and technically process that content solely to the extent necessary to provide and improve the Services. This licence ends when the content is permanently deleted from JCKFRUT's systems. Representations & Warranties You represent and warrant that: (a) you own or have the right to use all User Content you submit; (b) your User Content does not infringe any third-party rights; and (c) your User Content complies with the Acceptable Use Policy. Guest and Collaborator Content Guests and Collaborators who submit content grant JCKFRUT the same limited licence described above. Couples are responsible for ensuring Guests and Collaborators are aware their content will be processed in accordance with these Terms. Removal You may delete User Content through your account settings. Deleted content may remain in encrypted backups for up to 30 days before final purging, except where retention is required by law. No Backup Guarantee While JCKFRUT maintains regular backups, we do not guarantee that User Content will always be recoverable. You are encouraged to keep copies of important materials. Indemnity You agree to indemnify and hold JCKFRUT harmless from any claims, damages, or expenses arising from User Content you, your Guests, or your Collaborators submit that breaches these Terms or infringes any third-party right. • JCKFRUT's Ownership: The Platform, its software, design framework, templates, graphics, layouts, code, and all content created by JCKFRUT are the exclusive property of JCKFRUT (Pty) Ltd or its licensors, protected by South African and international intellectual property laws.• Restrictions: No rights are granted beyond the limited licence in Section 11.2. You may not copy, modify, distribute, sell, or create derivative works from JCKFRUT's intellectual property without prior written consent.• Trademarks: "JCKFRUT," the JCKFRUT logo, and associated product names are trademarks of JCKFRUT (Pty) Ltd. Unauthorised use is prohibited.• Custom Invitation Designs: Where JCKFRUT creates a bespoke custom invitation design under a separate written agreement, ownership will be as specified in that agreement. In the absence of any contrary agreement, JCKFRUT retains all intellectual property rights and grants you a non-exclusive licence to use it for your Event only.• Feedback: If you submit ideas, suggestions, or feedback, you assign to JCKFRUT all rights in that feedback and JCKFRUT may use it without obligation or compensation to you.• Third-Party IP: Content or trademarks belonging to third parties remain the property of their respective owners. POPIA Compliance (South Africa) For personal information JCKFRUT collects directly from Users, JCKFRUT acts as the "responsible party" under POPIA. For Guest data that Couples upload to the Platform, JCKFRUT acts as the "operator" processing that data on behalf of the Couple. GDPR Compliance (EEA, UK & Equivalent Jurisdictions) Where JCKFRUT processes personal data of individuals in the EEA or the United Kingdom, the following apply: • Lawful Basis for Processing: Contract performance, legitimate interests, consent, and legal obligation (as applicable under Article 6 GDPR).• Data Subject Rights: EEA and UK Users have the right of access, rectification, erasure, restriction of processing, data portability, the right to object, and rights related to automated decision-making. To exercise any of these rights, contact privacy@jckfrut.co. JCKFRUT will respond within 30 days.• Data Breach Notification: JCKFRUT will notify the relevant supervisory authority within 72 hours of becoming aware of a personal data breach posing a risk to data subjects, and will notify affected individuals where the breach poses a high risk.• International Data Transfers: Personal data may be transferred outside the EEA. JCKFRUT relies on appropriate safeguards including Standard Contractual Clauses (SCCs) approved by the European Commission.• EU Representative: As required by Article 27 GDPR, JCKFRUT will designate an EU representative for EEA data subjects. Details will be published in the Privacy Policy. Until appointed, EEA Users may direct enquiries to privacy@jckfrut.co.• Supervisory Authority: EEA Users may lodge a complaint with their local data protection authority. UK Users may lodge a complaint with the ICO. South African Users may lodge a complaint with the Information Regulator of South Africa. Couple Responsibilities as Data Controller / Responsible Party • Couples must ensure they have a lawful basis to collect and process each Guest's personal information.• Couples must ensure Guests are informed that their data will be processed by JCKFRUT's Platform.• Couples must comply with any data subject requests from their Guests.• Couples may not upload sensitive personal information (including health information, race, ethnicity, religious beliefs, or sexual orientation) without explicit consent from each data subject. Minors' Data JCKFRUT's Platform is intended for users aged 18 and over. Where personal data of individuals under 16 is added, the Couple is responsible for ensuring parental or guardian consent has been obtained where required by applicable law. Sub-Processors JCKFRUT engages Sub-Processors for payment processing (Paystack), transactional email delivery, cloud infrastructure and hosting, mapping services, and AI and machine learning services. A current list is available in the Privacy Policy. Cookie Policy The Platform uses cookies and similar tracking technologies. Full details are available at https://wedding.jckfrut.co/cookie-policy. Non-essential cookies are only placed with your explicit consent where required by law. Security JCKFRUT implements appropriate technical and organisational measures to protect personal information against loss, unauthorised access, and unlawful processing, consistent with POPIA and GDPR requirements. Automated Decision-Making & AI Features AI-generated outputs (including AI Seating Suggestions) are recommendations only, not binding decisions. No automated decision with a legal or similarly significant effect is made about any individual solely on the basis of automated processing. All final decisions are made by the Couple. Data Subject Rights RequestsAll data subject rights requests must be submitted to privacy@jckfrut.co. JCKFRUT will acknowledge receipt within 5 business days and respond substantively within 30 days. • Account Data: Retained for as long as your account is active and for a reasonable period thereafter to fulfil legal obligations or resolve disputes.• Invitation & Event Data: Retained until the Event date plus 90 days, after which it is deleted from active systems. Backup copies are purged within 30 days of deletion.• Chat Records: Retained for 24 months after the Event date, then permanently deleted, unless a legal obligation or unresolved dispute requires longer retention.• Legal and Compliance Holds: JCKFRUT may retain data for longer periods where required by applicable law, regulation, court order, or for the resolution of a dispute.• Payment Records: Transaction records are retained for the period required by applicable tax and financial legislation, currently a minimum of five (5) years in South Africa.• Erasure Requests: Where a valid erasure request is submitted under GDPR Article 17 or POPIA, JCKFRUT will delete the relevant data within 30 days, subject to any overriding legal obligation.• Availability Goal: JCKFRUT aims to keep the Platform available 24/7 but does not guarantee uninterrupted or error-free operation.• Planned Maintenance: Where practicable, maintenance will be scheduled during low-usage periods and communicated in advance.• Unscheduled Outages: JCKFRUT is not liable for interruptions caused by circumstances beyond its reasonable control, including internet disruptions, hosting provider failures, power outages, cyber-attacks, or force-majeure events.• Third-Party Services: The Platform relies on third-party providers for email delivery, payment processing, mapping, and AI functionality. JCKFRUT is not responsible for interruptions or failures caused by those providers.• "As Is" Basis: Except where prohibited by law, the Services are provided "as is" and "as available," without warranties of any kind.• AI Features: AI-generated outputs are provided for convenience only and do not constitute professional advice. JCKFRUT does not guarantee their accuracy or suitability.• No Professional Advice: Nothing on the Platform constitutes professional planning, legal, financial, logistical, or catering advice. • Exclusion of Indirect Damages: To the fullest extent permitted by law, JCKFRUT and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, or data.• Cap on Direct Damages: JCKFRUT's total aggregate liability is limited to the greater of (a) R500.00 / USD 25 / EUR 25 / GBP 20, or (b) the total amount you paid to JCKFRUT for the specific Tier or service giving rise to the claim.• Vendor Disputes: JCKFRUT is not a party to any agreement between a Couple and a Vendor. Disputes about vendor services are solely between those parties.• Chat Records: JCKFRUT makes no representation about the legal weight or admissibility of Chat Records in any proceeding.• Payment Processing: JCKFRUT is not liable for any loss or security incident arising from Paystack's payment processing services.• Exceptions: Nothing in these Terms limits liability for: (a) death or personal injury caused by JCKFRUT's gross negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot lawfully be limited under the CPA, GDPR, or any other applicable law.Termination by You You may close your account at any time by emailing wedding.support@jckfrut.co. Closing an account or deleting a project does not entitle you to a refund. Data will be deleted in accordance with Section 14. Termination by JCKFRUT JCKFRUT may suspend or terminate your account immediately, with or without notice, if: (a) you breach these Terms, the Acceptable Use Policy, or any applicable law; (b) JCKFRUT is required to do so by law or a competent authority; or (c) continuing to provide the Services poses a legal, security, or reputational risk. Effect of Termination • All licences and rights granted under these Terms immediately cease upon termination.• Access to invitations, planning tools, and chat features will be disabled.• Any unpaid fees become immediately due.• The following sections survive termination: Definitions, Data Protection, Intellectual Property, User Content & Licence, Limitation of Liability, Governing Law, and this Termination clause.JCKFRUT may update these Terms to reflect changes in the Platform, business operations, or legal requirements. When material changes are made, JCKFRUT will: (a) Post the updated Terms on the Platform with a new "Last Updated" date; and(b) Email account holders a summary of key changes at least 14 days before the changes take effect for existing users. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may close your account by emailing wedding.support@jckfrut.co.• These Terms are governed by the laws of the Republic of South Africa, without regard to its conflict-of-law principles.• You consent to the exclusive jurisdiction of the South African courts. All proceedings must be brought in the courts of Cape Town, Western Cape, unless applicable law requires a different forum.• Nothing in this clause limits the rights of EEA or UK Users to bring claims before their local courts or to seek relief from their local data protection supervisory authority under the GDPR.• Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through direct good-faith negotiation for a period of 30 days from the date of written notice of the dispute.• Nothing in this section prevents either party from seeking urgent or interim relief from a competent court.• The ECT Act applies to these Terms and all electronic transactions concluded through the Platform.• Entire Agreement: These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and JCKFRUT regarding the Platform.• Severability: If any provision of these Terms is found unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force.• No Waiver: JCKFRUT's failure to enforce any right or provision does not constitute a waiver of that right or provision.• Assignment: You may not assign your rights or obligations under these Terms without JCKFRUT's prior written consent. JCKFRUT may assign these Terms in connection with a merger, acquisition, or sale of assets.• Force Majeure: JCKFRUT is not liable for any failure or delay caused by circumstances beyond its reasonable control, including natural disasters, civil unrest, government action, pandemics, or internet infrastructure failures.• Language: These Terms are written in English. Any translated versions are for convenience only.
